The Five on Monday discussed congressional Democrats' recent push for possible prison time for President Trump following the release of court filings on Trump aide Michael Cohen by the Mueller team.

Party leaders have noted Cohen's admitting to an excessive campaign contribution and referring to payments made to porn star Stormy Daniels and Playboy model Karen McDougal.

Rep. Adam Schiff, D-Calif., who is widely expected to take over the House Intelligence Committee next year, said on Sunday that the president "faces the very real prospect of jail time" once he leaves office.

Trump tweeted that there's no "[smoking] gun" tying his 2016 campaign to the Kremlin and that the payment made to Stormy Daniels was "a simple private transaction."

Brian Kilmeade said that the Southern District of New York is trying to "take down" President Trump.

"Michael Cohen being directed or not being directed, that's what the Southern District of New York thinks is a problem," he said. "This is the reality. This is the game."

Morgan Ortagus added that if impeachment hearings for the president were to take place, it would reflect poorly on Democrats.

"If you just take a step back and think what these impeachment hearings could look like with this whole cast of characters, it would be terrible for Democrats going into 2020," she said. "But if they want to bring Avenatti up before the Congress and Stormy Daniels, I mean, be my guest."

Kilmeade said that Democrats are trying to make Trump "un-electable" in two years, and that any potential repercussion toward the president shouldn't be more than a fine.

"Unless the new Justice Department wants to put the screws to Trump," he said.
