'He Does Not Get a Pass': Charlie Rose's CBS Co-Hosts React to Sexual Harassment Claims

Neil Cavuto and Judge Andrew Napolitano discussed President Trump's comments on Judge Roy Moore (R-Ala.), who is vying for Attorney General Jeff Sessions' former senate seat.

Cavuto said that, despite Trump's comments that Moore denies allegations of sexual misconduct, the Alabamian faces an "uphill battle" before and after his possible election.

Napolitano said that if Moore is elected, the Senate must seat him. But, he said they could then move to formally expel him over his allegations.

"No person has ever been expelled from the Congress ever for behavior that occurred before they were in the Congress," their term, he said.

Napolitano said that the last member to be threatened with expulsion was former Sen. Bob Packwood (R-Ore.).

Around the time of the 1992 election, Packwood was hit with more than a dozen allegations of sexual misconduct, and eventually resigned his seat as pressure grew from legislators like Sen. Barbara Boxer (D-Calif.). Current Sen. Ronald Wyden (D-Ore.) took over Packwood's seat shortly after his 1995 resignation.

Napolitano added that President Trump appeared to mischaracterize Moore's opponent, Doug Jones (D), as a "liberal Democrat."

The judge said Jones was once a "Ku Klux Klan-busting former federal prosecutor who commanded respect across the political spectrum" and would be someone that Senate Republicans could "have a conversation with."

On the contrary, Napolitano said Jones arrives in the Senate, none of his colleagues will want to be seen with him. 

Moore's wife Kayla accused Jones of being an "ultra-liberal" who supports full-term abortions and gun control.

Jones laughed when Fox's Peter Doocy presented him with the comment, saying that a closer look at his positions show he's "pretty mainstream."
