The Justice Department has granted immunity to the former State Department staffer who set up Hillary Clinton’s private email server, according to reports.

A senior U.S. law enforcement official said that the FBI had secured the cooperation of Bryan Pagliano, who worked on Clinton’s 2008 presidential campaign before setting up the server in her New York home in 2009.

Ted Cruz said on "The Kelly File" tonight that this could be a sign the FBI investigation into possible criminal wrongdoing is progressing.

"This is an ominous development for the Clinton campaign and for Democrats as a whole," Cruz said.

He explained that by granting Pagliano immunity, the Justice Department will now be able to question him about what he was instructed to do by Clinton and her close associates.

"That suggests that the legal jeopardy is just getting greater and greater," Cruz said, adding that underscores the need for Republicans to nominate a strong candidate who can beat Clinton in November, if she makes it that far.
