Ted Cruz said on "Hannity" tonight that the passing of Supreme Court Justice Antonin Scalia underscores the incredibly high stakes of the 2016 election.

He said that the Supreme Court hangs in the balance, as do our constitutional rights.

"We risk losing our basic constitutional rights with one more liberal justice on the court," Cruz said. "We would have a five-justice left-wing majority that would undermine our constitutional rights for a generation."

He said it's been decades since a Supreme Court Justice was appointed during an election year, and we shouldn't break that trend now.

The Texas senator called for the 2016 election to be a referendum on the Supreme Court.

"Let the voters decide," Cruz said. "If the Democrats want to fill this vacancy, they need to win in November."
