Judge Andrew Napolitano said tonight on "The Kelly File" that there is "no legal justification for this kind of behavior" happening in Baltimore, referencing the violent protests in the city.

"It's hard to believe that it has gotten to this point and there's a lot of factors that can help explain it, but very few that can help justify it," Napolitano told Megyn Kelly. 

He said that the six officers involved in Freddie Gray's death should have been charged by now. 

"There cannot be the perception that when police cause death they are treated differently than when civilians cause death," he said.

Napolitano remarked that the leadership in the city has been "horrific."

"This happened nine days ago and the leadership of that city has done nothing to put its finger on the tipping point of these racial problems," he said. 

Napolitano added that it's almost impossible to identify and bring charges against the looters.
