An Indiana man who drugged and raped his wife while she slept – even recording the rapes – has avoided jail time.

David Wise, 52, was sentenced to eight years of home detention after he was convicted of rape and criminal deviant conduct. He can continue to travel to and from work.

Meanwhile, Judge Kurt Eisgruber told victim Mandy Boardman to forgive her attacker and move on.

Former homicide detective Ted Williams weighed in on the case, calling it “an embarrassment to the criminal justice system.”

“A woman’s body is her temple,” he said.

The judge is up for re-election, and Williams said he hopes the citizens will speak loud and clear so he is not placed back on the bench.

“Raped by her husband and raped by the criminal justice system. How can that happen?” he said.
