James Griffin, an 18-year-old student, was charged with battery after allegedly throwing milk at Colon, yelling gay slurs and then hitting him.

The school says it has a zero-tolerance policy on fighting.

Betterson is set to meet with school officials today about the punishment. He says the beating could have been much worse because Colon was not fighting back.
