A New Jersey mom has been added to the state’s child abuse registry for leaving her toddler alone in a car while she ran into the store.

The child was left alone for about 10 minutes, but was not hurt.

Criminal defense attorney Ashleigh Merchant and litigator Rebecca Rose Woodland joined Elisabeth Hasselbeck this morning on Fox and Friends to discuss the court’s decision.

Woodland argued that the mom left her toddler in the car for at least 10 minutes, which is negligent. “Clearly, you have to protect the infant, and who can do that but the state?” Woodland asked. “No one else can. An 18-month-old can’t speak for itself.”

Merchant called the ruling “excessive” and said the situation has been “over-criminalized.”
