The owners of the Empire State Building are suing a photographer over topless photos he took at the top of the landmark.

The $1.1 million suit against photographer and Iraq War veteran Allen Henson claims that topless photos he took of a woman were inappropriate and taken without permission.

However, Henson says it wasn’t a commercial shoot and being topless in New York City is not illegal.
