Dershowitz: If Cohen Was Behind Leak of Trump Tape, He Has a 'Serious Problem'
There is no evidence of a crime in the leaked tape of President Trump and his former attorney Michael Cohen, but Cohen could be in legal jeopardy if he was the source behind the leak, according to Alan Dershowitz.
In the secretly recorded audiotape from two months before the 2016 election -- which was provided to CNN by Cohen's lawyer Lanny Davis -- Cohen and Trump apparently discuss buying the rights to a Playboy model’s story claiming an affair with Trump.
Trump has denied the affair and his legal team says the transaction never occurred. Trump lashed out Wednesday morning over the release of the tape.
What kind of a lawyer would tape a client? So sad! Is this a first, never heard of it before? Why was the tape so abruptly terminated (cut) while I was presumably saying positive things? I hear there are other clients and many reporters that are taped - can this be so? Too bad!

"It sounds like Cohen is not as loyal to the president as he once was," Dershowitz, a Harvard Law professor emeritus, said on "Fox & Friends."
He said the conversation never should have been recorded in the first place, let alone released in the media.
"You trust your lawyer to have a discreet conversation so that you can lay out all the possibilities and then decide what to do. The end result is, no payments were made, no cash was given, so this is a big deal about nothing," Dershowitz said.
He noted that Cohen, however, could have a "serious problem" if he was behind the leak.
"But we don’t know who the source of the leak is. That’s one of the things I think we have to get to the bottom of," Dershowitz said.
He added that the tape -- which is one of 12 recordings seized from Cohen's apartment, office and hotel room by federal investigators in April -- ends abruptly, which he said suggests either Cohen erased what he didn’t want anybody to hear or he intentionally cut it off.
