Rick Santorum said tonight in the first of two Fox News Republican presidential debates that same-sex marriage is far from settled law.

"It is not anymore than Dred Scott was settled law to Abraham Lincoln," Santorum said, calling it a "rogue Supreme Court decision" with no constitutional basis.

"Sometimes it just takes someone to lead and stand up to the court," Santorum said.

Tune in to the primetime debate, moderated by Bret Baier, Megyn Kelly and Chris Wallace, at 9p ET.

When it's all over, join Megyn on "The Kelly File," followed by a live "Hannity" at midnight ET.
