A man in Oklahoma allegedly threatened a murder and is now facing terror charges, but another man is accused of beheading a coworker, and the case is being treated as workplace violence.

Judge Andrew Napolitano was on “The Kelly File” tonight to weigh in, calling the two situations “awfully inconsistent.”

Napolitano said that the Department of Justice "should not be reluctant" to file a terror charge against Oklahoma beheading suspect Alton Nolen.

”Yet this Justice Department often seems more concerned with political correctness than it does with its affirmative legal obligation to keep Americans safe,” he said.
