Judge Andrew Napolitano was on “The Kelly File” tonight to discuss the U.S. accusation that Russia has violated a 1987 missile treaty.

Napolitano said that Russia has tried to pull back from this treaty for years.

“This is a lawful, binding treaty,” he said. However, Napolitano explained that there is no Supreme Court and no place for the U.S. to go on this.

Napolitano said that Obama is revealing this information now because he has a 28 percent approval rating and wants the American people to rally around him.

“He’s known about it for months,” he said.
