On Wednesday, a Mexican judge has ordered the United States Marine jailed in Mexico back behind bars. The attorney for Sgt. Andrew Tahmooressi went ‘On The Record’ with Greta Van Susteren tonight.

Tahmooressi was arrested for making a wrong turn at the border with guns in his vehicle over three months ago.

His lawyer Fernando Benitez said the arrest is tainted by human rights violations and that evidence shows Sgt. Tahmooressi accidentally crossed the border from San Diego, California into Mexico.

Benitez said, “He has already clarified what happened in extreme detail and I believe the more we advance with the hearing of evidence to support that, the clearer it will become.”

He described the Marine as being “candid” with the judge and in good spirits. Benitez told Greta that it seemed like the prosecution was focusing on the fact that Tahmooressi had been to Mexico before.

“I’ve been a resident of the border for more than 40 years and I’ve made that mistake many times. Many residents have made that mistake that Andrew did and we can relate to that. So it has no bearing whether or not he was in Mexico before.”
