A Republican senator introduced new legislation Wednesday that would overturn every decision made by the National Labor Relations Board in the last year. This comes on the heels of a court ruling that President Obama exceeded his constitutional authority by making NLRB appointments when the Senate was on a break.

Judge Napolitano believes that “the White House will take the position that if you don’t like the decisions that were made, challenge the decisions.”

The judge says that these recess decisions are nothing new. “In fairness to Barack Obama, with whom I disagree on almost everything, he used far fewer recess appointees than George W. Bush did.”
