Fox News legal analyst Peter Johnson Jr. stopped by Fox and Friends this morning to discuss Friday's resignation of CIA Director Gen. David Petraeus, who stepped down after admitting to an affair.

Johnson Jr. pointed out that with the upcoming Congressional hearings on the Libya attack, Petraeus' departure only raises more questions about the situation.

"Is Petraeus now the fall guy for what happened in Benghazi? Either appropriately or inappropriately. The State Department scenario is, 'CIA was supposed to provide security. Did they provide security on that day? We weren't involved, it was a CIA operation,'" Johnson Jr. said.
